Terms of Service

These terms govern use of digitalrooftop.com. Client services, fees, deliverables, and responsibilities are governed by a separate written agreement.

1. Acceptance and scope

These Terms of Service (“Terms”) apply when you access or use digitalrooftop.com (the “Site”), operated by Digital Rooftop LLC (“Digital Rooftop,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site is intended for adults and business users. If you are under 18, do not submit the contact form without permission from a parent or legal guardian.

2. Information about our services

The Site provides general information about marketing, search visibility, paid advertising, website development, software, and related services. Site content, example pricing, service descriptions, timelines, and availability are informational and may change.

A contact-form submission, conversation, proposal, or estimate does not by itself create a client, agency, fiduciary, partnership, employment, or other professional relationship. We provide services only after the parties agree to a separate written contract that states the applicable scope, fees, responsibilities, and other project terms. If that contract conflicts with these Terms, the contract controls for those services.

3. Permitted use

You may use the Site for lawful informational and business-evaluation purposes. You may not:

  • Break the law, infringe another person’s rights, or misrepresent your identity.
  • Attempt to bypass security, probe for vulnerabilities, or gain unauthorized access.
  • Introduce malicious code, overload the Site, or interfere with its operation.
  • Copy, scrape, republish, or commercially exploit substantial Site content except with our written permission or as allowed by law. Ordinary search-engine indexing and linking to public pages are permitted.

We may restrict access when reasonably necessary to protect the Site, our users, or our rights.

4. Intellectual property

The Site and its text, design, graphics, branding, software, videos, images, and other materials are owned by Digital Rooftop or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to use the Site for its intended purpose. No other license is granted.

Digital Rooftop names, logos, and marks may not be used in a way that suggests sponsorship, endorsement, or affiliation without written permission. Third-party names and marks belong to their respective owners.

5. Information you submit

You retain ownership of information you submit. You give us permission to process and share it with our service providers as reasonably necessary to review your inquiry, communicate with you, protect the Site, and provide services you request. Our Privacy Policy explains this processing in more detail.

You represent that the information you submit is accurate, lawful, and that you have the right to provide it. Unless we already have a written agreement that says otherwise, a Site submission is not treated as confidential or privileged. Do not submit passwords, payment information, trade secrets, regulated data, or another person’s confidential information.

6. Results, case studies, and estimates

Case studies and past results describe particular circumstances and do not guarantee future performance. Marketing, search rankings, advertising performance, leads, revenue, and project outcomes depend on many factors outside our control. Any forecast, estimate, or example is illustrative unless a separate written agreement expressly says otherwise.

7. Third-party services and links

The Site may link to or rely on third-party services. Those services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party websites, content, availability, or conduct. A link does not necessarily mean we endorse the third party.

8. Site availability and changes

We may modify, suspend, or discontinue any part of the Site. We do not promise that the Site will always be available, uninterrupted, secure, or error-free, or that every item of content will remain current. We may correct errors and update content without notice.

9. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” Digital Rooftop disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Site content is general information and is not legal, financial, accounting, or other regulated professional advice.

Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Digital Rooftop and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the Site.

To the fullest extent permitted by law, our total liability for all claims arising from or related solely to the Site will not exceed one hundred U.S. dollars (US $100). These limits do not apply where liability cannot legally be excluded or limited. Liability relating to paid client services is governed by the applicable written client agreement.

11. Indemnity

To the extent permitted by law, you agree to defend and indemnify Digital Rooftop from third-party claims, damages, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or information you submit without the required rights. This section does not require you to indemnify us for our own unlawful conduct.

12. Privacy

Our Privacy Policy explains how we handle personal information through the Site. It is a separate notice and does not form part of these Terms.

13. Accessibility

We aim to make the Site usable by people with disabilities. If you have difficulty accessing content or using the contact form, email contact@digitalrooftop.com and describe the page and problem. We will make reasonable efforts to provide the information or assistance through an accessible alternative.

14. Governing law and disputes

Texas law governs these Terms, without regard to conflict-of-law principles. Any dispute relating solely to the Site will be brought in a state or federal court with jurisdiction in Texas, unless applicable law requires another forum. Before filing a claim, each party agrees to make a good-faith effort to resolve the issue informally by written notice.

15. General terms

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, or sale of the business. These Terms are the entire agreement about use of the Site itself.

16. Changes and contact

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively from the stated date. If a change is material, we will provide additional notice when required by law.
